The Corrupt Corporate Incarceration Complex

By William Fisher
Truthout

Seventeen-year-old Hillary Transue did what lots of 17-year-olds do: Got into mischief. Hillary's mischief was composing a MySpace page poking fun at the assistant principal of the high school she attended in Wilkes-Barre, Pennsylvania. Hillary was an honor student who'd never had any trouble with the law before. And her MySpace page stated clearly that the page was a joke. But despite all that, Hilary found herself charged with harassment. She stood before a judge and heard him sentence her to three months in a juvenile detention facility.

What she expected was perhaps a stern lecture. What she got was a perp walk - being led away in handcuffs as her stunned parents stood by helplessly. Hillary told The New York Times, "I felt like I had been thrown into some surreal sort of nightmare. All I wanted to know was how this could be fair and why the judge would do such a thing."

It wasn't until two years later that she found out why. In Scranton, Pennsylvania, two judges pleaded guilty to operating a kickback scheme involving juvenile offenders. The judges, Mark Ciavarella Jr. and Michael Conahan, took more than $2.6 million in kickbacks from a private prison company to send teenagers to two privately run youth detention centers. Since 2003, Ciaverella had sentenced an estimated 5,000 juveniles. Conahan was accused of setting up the contracts. Many of the youngsters shipped off to the detention centers were first-time offenders.

PA Child Care is a juvenile detention center in Pittston Township, Pennsylvania. It was opened in February 2003. It has a sister company, Western PA Child Care, in Butler County, Pennsylvania. Treatment at both facilities is provided by Mid Atlantic Youth Services. Gregory Zappala took sole ownership of the company when he purchased co-owner Robert Powell's share in June 2008.

In July 2009, Powell pled guilty to failing to report a felony and being an accessory to tax evasion conspiracy in connection with $770,000 in kickbacks he paid to Ciavarella and Conahan in exchange for facilitating the development of his facilities.

The childcare facilities have also been criticized for their costs, which ranged as high as $315 per child per day. Butler County paid Western PA Child Care about $800,000 in payments between 2005 and 2008. Butler County did not renew Western PA Child Care's contract after an extension of the contract ran out at the end of 2008.

The juvenile detention center Hillary was sent to was a private, for-profit facility run by one of the more than 50 companies operating in the five billion dollar private prison industry.

These companies have names you've probably never heard of - like Corrections Corporation of America (CCA) and GEO.

Ironically, it's the federal and state criminal justice systems that produce the private prisons phenomenon and create the opportunity for private operators to capitalize. What they are capitalizing on is America's obsession with handing out long prison sentences out of all proportion to the crimes committed.

Today, the United States has locked up more prisoners than any other country in the world - 2.3 million-plus people locked up in state and federal prisons and county jails. This has predictably resulted in a shortage of publicly owned prison beds - a shortage increasingly being filled by companies that charge so many dollars for each convict sent their way.

Detainees include immigrants who have applied for asylum in the US and others awaiting hearings before being deported. The number of people detained has soared to more than 400,000 a year. According to Immigration and Customs Enforcement (ICE), part of the sprawling Department of Homeland Security (DHS), the average detention is about one month, although some detainees are kept for years. The cost of detention is estimated to be $1.7 billion annually.

In the past five years, the nation's largest private prison company has partnered with the federal government to detain close to a million undocumented people waiting to be deported or to appear before an immigration judge. In the process, CCA has made record profits. Critics suggest that CCA cuts corners on its detention contracts in order to increase its revenue at the expense of humane conditions. Thanks to political connections and lobbying, it dominates the immigrant detention industry. CCA now has close to 10,000 new beds under development in anticipation of continued demand.

Judith Greene, a policy analyst with Justice Strategies, a nonprofit sentencing-reform advocacy group in New York, says, "Profits by no means created the machinery of mass incarceration, no more than defense contracts invented war, but the huge profits to be made by incarcerating an ever-growing segment of our population serves the system very well."

"Profits oil the machinery, keep it humming and speed its growth," she adds.

For-profit prison companies claim to be able to provide prison and detention services to cities, counties, states and the federal government for less money - an idea that cash-strapped communities apparently find irresistible.

Yet, studies throughout the country show that private prisons are only marginally less expensive than public prisons and are often substantially more expensive. The second issue is a medical care regimen that, until recently, allowed the government such wide discretion that it could deny urgent care, including biopsies for suspected cancers and treatment of heart conditions.

Moreover, a panoply of hidden subsidies is rarely calculated into the private prison industry's cost claims. According to a study by Paul Wright, the founder and editor of "Prison Legal News," a prisoners' rights advocacy newsletter, at least 44, or 73 percent, of the 60 facilities (studied) had received a development subsidy from local, state and/or federal government sources. Subsidies were found in 17 of the 19 states in which the 60 facilities are located.

Facilities operated by the two largest private prison companies, CCA and GEO, were frequently subsidized. Among the facilities in this study, 78 percent of CCA's and 69 percent of GEO's prisons were subsidized, suggesting that these companies had been aggressive in seeking development subsidies.

According to the not-for-profit Private Corrections Institute, "the private prison industry relies on a number of allies and research studies to justify its claims of cost savings and proficiency; however, most of these sources have industry connections or vested financial interests."

For example, it claims, the Reason Foundation, a strong proponent of prison privatization, has received funding from private prison firms. The American Correctional Association (ACA) receives sponsorship money from CCA, GEO, and other private prison companies for its biannual conferences.

Former University of Florida Prof. Charles Thomas conducted supposedly impartial research on the private prison industry until it was learned that he owned private prison stock, had been paid $3 million for consulting for a private prison firm and served on the board of Prison Realty Trust (a CCA spin-off). Thomas was fined $20,000 by the Florida Commission on Ethics and stepped down from his university position.

Private prisons are paid according to filled beds. So, they are constantly pushing for more inmates - while officials of publicly owned prisons are trying to shed prisoners to relieve overcrowding and reduce expenses.

Leading docs say NO to full- body scanners

By WC Douglass M.D

It's not often I'm on the same page as the American Cancer Society -- but their chief medical officer is taking a page out of my book, and I couldn't be happier about it.

Dr. Otis Brawley told CNN he refuses the TSA's radioactive full-body airport scanners because he has "little confidence" in how the machines are calibrated, maintained, and inspected.

And his deputy agrees -- saying he'll do whatever he can to skip the scans.

These are two of the leading mainstream voices on cancer issues -- and they've been wrong more times than I can count, especially on issues like mammograms and cancer treatments.

Heck, they push radiation on cancer patients every single day... but when their own lives are on the line, they change their tune -- and fast.

"This is a total body scan -- not a dental or chest X-ray," Brawley's deputy, Dr. Len Lichtenfeld, told CNN. "Total body radiation is not something I find very comforting based on my medical knowledge."

And you know what? He's absolutely right -- because every time you get zapped, your total lifetime exposure levels shoot right up... along with your overall cancer risk.

Eventually, something that's supposed to be a remote and theoretical risk becomes a very real battle for your life... all because the feds decided they needed a picture of your scrotum.

Of course, the only alternative to the full-body scanner is the "freedom fondle" -- a top-to-bottom groping by a TSA worker that'll leave you feeling like a hooker in a gas station bathroom.

And they're not just rubbing their gloved fingers over your privates -- they're even fondling children, as this video on YouTube shows.

Want to know what's really shocking about this footage? This girl's parents didn't refuse the scan. They actually sent her through -- but the feds called the six-year-old girl over for an "extra" screening anyway, giving her the worst of both worlds: radiation AND a fondling.

And as you can see, they didn't miss an inch of this little potential terrorist's body.

It's just plain sick.

Feds eyeing online forums to correct "misinformation"

The next time you post an opinion in an online forum or a Facebook group message board, don't be surprised if you get a rebuttal from a federal employee.

The government is looking for ways to monitor online chatter about political issues and correct what it perceives as misinformation.

The move started recently with a pilot project on the East Coast seal hunt. A Toronto-based company called Social Media Group has been hired to help counter some information put forward by the anti-sealing movement.

The Department of Foreign Affairs and International Trade has paid the firm $75,000 "to monitor social activity and help identify ... areas where misinformation is being presented and repeated as fact," Simone MacAndrew, a department spokesperson, said in an email.

The firm alerts the government to questionable online comments and then employees in Foreign Affairs or the Department of Fisheries and Oceans, who have recently been trained in online posting, point the authors to information the government considers more accurate.

It appears to be just the beginning.
The seal hunt pilot project was set up in part "to establish foundations and recommendations for future programs and campaigns to use social media as another way to listen to, inform and engage with Canadians," MacAndrew added.

For some, the move to online monitoring was to be expected.
"I think we're seeing the government recognize that millions of Canadians are actively participating online in social networks," said Michael Geist, a law professor at the University of Ottawa who specializes in Internet law.
"We've had Facebook groups in Canada that have grown to the tens of thousands or hundreds of thousands of people, and they've clearly had a direct impact on public policy."

Geist himself launched such a Facebook group in 2007. He managed to get more than 84,000 members to help denounce a proposed copyright law that critics said would have restricted the way in which people use, copy or share books, movies and music they purchase. The bill was eventually put up for public consultations and is expected to be reintroduced in Parliament in the coming days. It remains to be seen, however, whether the online group managed to convince the government to alter the bill.

The commercial seal hunt might be an ideal test case for government involvement in online debate. The issue has polarized Canadians.

Opponents call the hunt cruel and needless and say seals are sometimes skinned alive or killed as whitecoated newborns. Supporters point out that regulations governing the hunt forbid both tactics and the hunt is heavily monitored. They accuse opponents of spreading lies by having celebrities such as Paul McCartney pose with whitecoat seals, pleading for their protection.

Some groups are wary of government employees being paid to post comments.
"I would certainly hope they would be up front about who they are," said Sheryl Fink, a senior researcher with the International Fund for Animal Welfare, a group which has long opposed the seal hunt.
"I think it does (help) if it's a link to an actual study. If it's a link to a press release that's got inaccurate information, that's not helping at all. It's, I guess, the distinction between the communications side of the government departments ... and the actual science or data."

US government software creates "fake people" on social networks to promote propaganda

The US government is offering private intelligence companies contracts to create software to manage "fake people" on social media sites and create the illusion of consensus on controversial issues.

The contract calls for the development of "Persona Management Software" which would help the user create and manage a variety of distinct fake profiles online. The job listing was discussed in recently leaked emails from the private security firm HBGary after an attack by internet activist last week.

According to the contract, the software would "protect the identity of government agencies" by employing a number of false signals to convince users that the poster is in fact a real person. A single user could manage unique background information and status updates for up to 10 fake people from a single computer.

The software enables the government to shield its identity through a number of different methods including the ability to assign unique IP addresses to each persona and the ability to make it appear as though the user is posting from other locations around the world.

Included in HBGary's leaked emails was a government proposal for the government contract. The document describes how they would 'friend' real people on Facebook as a way to convey government messages. The proposal reads:
"Those names can be cross-referenced across Facebook, twitter, MySpace, and other social media services to collect information on each individual. Once enough information is collected this information can be used to gain access to these individuals social circles.

Even the most restrictive and security conscious of persons can be exploited. Through the targeting and information reconnaissance phase, a person’s hometown and high school will be revealed. An adversary can create a classmates.com account at the same high school and year and find out people you went to high school with that do not have Facebook accounts, then create the account and send a friend request. Under the mutual friend decision, which is where most people can be exploited, an adversary can look at a targets friend list if it is exposed and find a targets most socially promiscuous friends, the ones that have over 300-500 friends, friend them to develop mutual friends before sending a friend request to the target. To that end friend’s accounts can be compromised and used to post malicious material to a targets wall. When choosing to participate in social media an individual is only as protected as his/her weakest friend."

Other attachments in the leaked emails include quotes from HBGary CEO Aaron Barr saying, "There are a variety of social media tricks we can use to add a level of realness to all fictitious personas... Using hashtags and gaming some location based check-in services we can make it appear as if a persona was actually at a conference and introduce himself/herself to key individuals as part of the exercise, as one example."

Additional emails between HBGary employees, usually originating from Barr, discuss the vulnerability social networking causes.

One employee wrote, "and now social networks are closing the gap between attacker and victim, to the point I just found (via linked-in) 112 females, wives of service men, all stationed at Hurlbert Field FL - in case you don't know this is where the CIA flies all their "private" airlines out of. What a damn joke - the U.S. is no longer the super power in cyber, and probably won't be in other areas soon."

Barr also predicted a steady rise in clandestine or secret government operations to stem the flow of sensitive information.  "I would say there is going to be a resurgence of black ops in the coming year as decision makers settle with our inadequacies... Critical infrastructure, finance, defense industrial base, and government have rivers of unauthorized communications flowing from them and there are no real efforts to stop it."

The creation of internet propoganda software is only one of HBGary's controversial activities. According to Wikileaks competetor and occasional collaborator Cryptome.org, several other progressive organizations were intended to be targeted including anti-war activist, anti-torture organizations and groups opposed to the US Chamber of Commerce.

The emails also include a number of other embarrasing entries including the purchase of the book "The Multi-Orgasmic Man: Sexual Secrets Every Man Should Know" from Amazon for $6.76.

What's wrong with the body scanners?

In short: EVERYTHING!
If you want to catch "terrorists", go and learn from the Israelis and do profiling.
